The right contract for your state or territory
Under the Land and Business (Sale and Conveyancing) Act 1994, a South Australian vendor must give the purchaser a Form 1 before an auction, and otherwise before settlement. BYB orders the searches, has a licensed conveyancer prepare the Form 1, and includes the search costs in the price.

Since 1 August 2025, the Property Law Act 2023 requires sellers to provide a Seller Disclosure Statement (Form 2) before the contract is signed.
What's required
Sellers must provide buyers a Seller Disclosure Statement (Form 2) before the contract is signed. It must include detailed property disclosures such as title, easements, zoning, and building approvals. To complete it accurately, the vendor answers a set of questions about the property, and the statement is then prepared and signed off by a licensed conveyancer.

Western Australia
Legal framework
Governed by the Sale of Land Act 1970 and the Transfer of Land Act 1893, with strata sales under the Strata Titles Act 1985.
What's required
WA operates largely on a buyer-beware basis with no mandatory vendor disclosure statement. Sales use the standard Contract for Sale by Offer and Acceptance with the Joint Form of General Conditions. Strata sales require a seller disclosure statement (Forms 28 and 29).
